Welcome to askdave.ai. By using our service, you agree to these terms. We've written them in plain English because we respect your time.

1. What Ask Dave is

Ask Dave is an AI-powered chat assistant with customisable personalities. Dave uses artificial intelligence to answer questions, provide advice, and help with tasks. Dave is helpful, but he's not a licensed professional.

2. What Dave is NOT

This is important:

• Dave is not a doctor. Don't use Dave's responses as medical advice. See a real doctor.
• Dave is not a lawyer. Don't rely on Dave for legal advice. Consult a qualified solicitor.
• Dave is not a financial adviser. Don't make financial decisions based solely on Dave's responses. Speak to a licensed financial adviser.
• Dave is not always right. AI can make mistakes, hallucinate facts, or give outdated information. Always verify important information independently.

3. Your account

• You must be at least 13 years old to use Ask Dave.
• You're responsible for keeping your account credentials secure.
• One account per person. Don't share accounts.
• You can cancel your subscription at any time — no lock-in contracts.

4. Acceptable use

Don't use Ask Dave to:

• Generate harmful, illegal, or abusive content
• Harass, threaten, or impersonate others
• Attempt to break, hack, or reverse-engineer the service
• Spam or abuse the free tier (automated bulk requests)
• Use Dave's responses to mislead people (e.g., pretending AI-generated content is human-written professional advice)

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions & payments

• Paid plans are billed monthly in AUD (Australian Dollars).
• Payments are processed securely via Stripe.
• You can cancel anytime — your access continues until the end of the billing period.
• Refunds are handled on a case-by-case basis. If Dave's broken and it's our fault, we'll make it right.
• We may change pricing with 30 days' notice. Existing subscribers keep their current rate until the next renewal.

6. Free tier

• The free tier is limited to 10 messages per day.
• We may adjust free tier limits at any time.
• Free tier conversations are not permanently stored.

7. Community Daves

• You can create custom Dave personalities and share them publicly.
• Don't create personalities that promote hate, violence, or illegal activity.
• We reserve the right to remove community Daves that violate our guidelines.
• By sharing a community Dave, you grant askdave.ai a licence to host and distribute it on the platform.

8. Intellectual property

• You own your conversation content.
• We own the askdave.ai platform, branding, and built-in Dave personalities.
• You own any custom Dave personalities you create.

9. Limitation of liability

To the maximum extent permitted by Australian law:

• Ask Dave is provided "as is" without warranty of any kind.
• We're not liable for decisions you make based on Dave's responses.
• Our total liability is limited to the amount you've paid us in the last 12 months.
• We're not liable for any indirect, incidental, or consequential damages.

10. Changes to these terms

We may update these terms from time to time. We'll notify you of material changes via email or a prominent notice on the site. Continued use after changes constitutes acceptance.

11. Governing law

These terms are governed by the laws of Australia. Any disputes will be resolved in Australian courts.

12. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
